Collection Agency Tips for Louisville Businesses
Frequently, our clients request that we add collection fees to the principal due amount that we are collecting. Unfortunately, in the USA, this is possible only if there is a formal signed agreement between your customer and your company that states this explicitly. The same is true for adding attorney fees to the principal due amount, and simply adding this clause to your invoices may not suffice in a court of law. To protect yourself in the event your customer doesn’t pay, you need a document signed by your customer stating that they are responsible for collection costs and/or attorney fees in the event they don’t pay on time. The easiest way to get this is to add it to your Credit Application because the customer typically signs this document at the start of your business relationship. A collection agency may or may not be able to successfully collect collection fees, but having the right to pursue them gives the agency significantly more negotiation power during the debt collection, litigation and judgment collection activities.
